Supreme Court to hear questions in case of womans death after rough

first_imgWARNING: Some of the details in this story are graphic.OTTAWA _ The case of an Ontario trucker acquitted in the death of an Alberta woman referred to at trial as a “native” and a “prostitute” is to go before the Supreme Court this week in what could set a precedent in Canada’s sexual assault laws.Bradley Barton says Cindy Gladue died after a night of consensual, rough sex in an Edmonton motel in June 2011. Her body was found in the bathtub after Barton called 911. She had an 11-centimetre cut in her vagina and had bled to death.A jury found Barton not guilty of first-degree murder and manslaughter. The Crown appealed following nationwide protests and the Alberta Court of Appeal ordered a new trial.The Appeal Court ruled serious errors were made in the original trial and in the judge’s charge to the jury about Barton’s conduct and on sexual assault legislation as it pertains to consent.The Supreme Court is to hear arguments Thursday on several procedural matters, including the role of interveners, but may also decide for the first time whether an “objective likelihood of harm” cancels out sexual consent.The Alberta Crown, as well as attorney generals in other provinces, including Ontario, is arguing for such an addition to the law.Barton’s lawyer, Dino Bottos, says it would be a big deal if the top court agrees. He plans to argue that the Crown brought up the consent versus harm argument on appeal, not at trial, and it shouldn’t affect his client’s case.It would be akin to double jeopardy, Bottos says. “We’re just trying to hold the line.”Lise Gotell is a gender studies professor at the University of Alberta and chairwoman of the Women’s Legal Education and Action Fund, or LEAF, one of 16 groups intervening in the Barton case. She points out the court has previously ruled that a person killed in a fist fight couldn’t have consented to bodily harm.“But the court has never made a ruling on whether or not this rule applies in a sexual context.”The Barton case is complicated, says Gotell, who adds that LEAF won’t argue for the new consent provision because it believes Gladue didn’t agree at all.Barton has testified that he hired Gladue for two nights of sex that included putting his fist in her vagina. When he woke up after the second night, he said, he found her dead in the tub.A medical examiner testified that the wound to Gladue’s vaginal wall was likely to have been caused by a sharp object and, in a rare move, he used Gladue’s preserved vaginal tissue as an exhibit.That was disrespectful and dehumanizing, says Gotell, as were the comments from lawyers who referred to Gladue more than two dozen times before the jury as a native prostitute.The 36-year-old Metis woman was a mother of three girls. She struggled with addiction and poverty and deserved better, says a factum filed by lawyers with another intervener, the National Inquiry into Missing and Murdered Indigenous Women and Girls.“We recall her strength and dignity now because the trial in relation to her death failed to do so,” it says.Muriel Stanley Venne, the founder of the Institute for the Advancement of Aboriginal Women, a co-intervener with LEAF, says there’s never been a better time, in light of the #MeToo movement, for a case like this to be heard.“I believe this is the most important case in my lifetime,” says Venne, who is 80. “Our Cindy Gladue is the embodiment and the hero that we are looking for to change the conduct of the court.”last_img read more

Monster pothole near Langton

Norfolk County will have to get out its chequebook now that a monster pothole has opened on a major road west of Simcoe.The failure occurred late last month on McDowell Road West about 4.5 kilometres west of Forestry Farm Road.The county flagged the problem on the afternoon of April 25. The road has since been closed with heavy concrete barricades. Nearly two weeks later, Norfolk’s roads department has no timetable for resuming through-traffic.“As far as an update goes, one will be provided at (Tuesday’s) council-in-committee meeting,” Norfolk roads manager Shawn VanAcker said Monday in an email.Whatever the county comes up with, the fix will not be easy or cheap.The failure occurred in the middle of McDowell Road in a section where the road bed is more than 20 feet higher than the surrounding landscape.A swale on the north side of the road empties into a pond on the south side. They are joined in the middle by a culvert, which the county says failed.The road bed collapsed into the space created by the broken culvert. The hole in the middle of the road measures about 10 feet across by seven feet (three metres by 2.1 metres). Installing a new culvert will require a deep excavation.“It’s quite a hole,” Langton Coun. Roger Geysens said Monday. “From what I hear, this is going to take a bit of time. It’ll have to be done sooner or later, that’s all I can say.”McDowell Road is a busy thoroughfare. It carries traffic from the west part of Norfolk into the west side of Simcoe. The road turns into West Street within Simcoe town limits and ends at Talbot Street South on the west side of Governor Simcoe Square.For the time being, the county recommends motorists use Norfolk Road 21 as a bypass. The Norfolk Road 21 access in the west is Highway 59 while the access in the east is off Forestry Farm Road.Tuesday’s meeting of Norfolk council begins at 3 p.m. in the council chamber at Governor Simcoe Square. Liberia UN agency joins team probing reports of fresh fighting outside Monrovia

UN High Commissioner for Refugees (UNHCR) representatives joined the inter-agency team investigating new reports of large-scale displacement sparked by recent rebel fighting outside Monrovia, and assessing humanitarian conditions in the host areas near Totota, Salala and Kakata towns. Yesterday, the sound of shelling north of Totota sent thousands of people fleeing towards the three towns looking for safety.In Totota alone, an estimated 80,000 internally displaced people (IDPs) have sought shelter in transit centres. In Salala, the International Committee of the Red Cross (ICRC) is planning to set up a second camp to cope with the recent influx. A separate group of over 6,000 people is believed to be living in a new IDP camp between Salala and Kakata.Meanwhile, UNHCR said security measures and aid distribution continue in Monrovia’s refugee camps. Security has been beefed up in VOA, Banjor and Samukai refugee camps, with three daily patrols by the West African ECOMIL troops. UNHCR has also been exploring the possibility of creating refugee watch teams trained in specific protection and security concerns, and equipped with basic tools like flashlights and whistles.UNHCR has also been providing aid to some of the eight IDP camps in Monrovia. In Perry Town camp, UNHCR has transported relief supplies for 435 families to be distributed by a local non-governmental agency later this week. Some 3,600 displaced people have returned to Perry Town, which used to host 8,000 people. When he tried to murder Scott the gun jammed.After Newton was arrested and subsequently jailed for firearms offences, Meighan says he made a full statement to Scotland Yard detectives about the `Ritz Conspiracy’ meeting.He told Mangold, however, that he subsequently signed a new police statement which made no mention of Thorpe, the Ritz Conspiracy meeting, or his own criminal offence in possessing and supplying a firearm. As a result vital evidence which might well have led to Thorpe’s conviction was never revealed.

Soros predicts 25 year slump in Europe without action

first_imgBILLIONAIRE INVESTOR GEORGE Soros said Europe faces 25 years of Japanese-style stagnation unless politicians pursue further integration of the currency bloc and change policies that have discouraged banks from lending.While the immediate financial crisis that has plagued Europe since 2010 “is over,” it still faces a political crisis that has divided the region between creditor and debtor nations, Soros, 83, said in a Bloomberg Television interview in London today. At the same time, banks have been encouraged to pass stress tests, rather than boost the economy by providing capital to businesses, he said.Europe “may not survive 25 years of stagnation,” Soros said in the interview with Francine Lacqua. “You have to go further with the integration. You have to solve the banking problem, because Europe is lagging behind the rest of the world in sorting out its banks.”Soros, whose hedge-fund firm gained about 20 percent a year on average from 1969 to 2011, has been a constant critic of how the European currency bloc was designed and of budget cuts imposed on indebted nations such as Greece and Spain at the height of the crisis. A weekend trip from Melbourne to Athens to attend the protest rally

first_imgThe journey from Australia to Greece is far from an easy one. You spend a whole day on air and when you arrive, you need a couple more to adjust. Imagine doing that just for the weekend. Zoi Petalidou did just that: on Friday 2 February, she got off work, went to the airport, made the long journey, and on Monday she was back to work. In the meantime, she got to be among the 140,000 people who flocked the Syntagma square to protest against the negotiation talks between Greece and the Former Yugoslav Republic of Macedonia. “I experienced the most beautiful thing that any Greek soul can offer, by just doing my duty,” she says. “Because this is how I seet it. As my duty and what my soul needed.”The protest itself exceeded her expectations. “It’s hard to put into words,” she says, describing how she was one of the first to arrive, still exhausted from the arduous flight and the fact that she’d been working till the last minute, but was also one of the last to leave Athens’ central square. Zoi Petalidou, while traveling from Melbourne to Athens.“Greek people were shouting, crying, singing along with me,” she remembers. “It was a beautiful spring day, it was something unprecedented. Sunday passed very quickly.”Her decision to do this unusual weekend trip came on the spur of the moment. “I go wherever I can, whenever my country needs me,” she says, and notes that there were others like her, coming from all parts of the world, although not for such a brief stay. “I would do this in a heartbeat,” she says, pointing to her background as a proud Macedonian of Pontian origins, born in Thessaloniki. “Now it’s time for the Melbourne rally,” she says. “I will be there alongside all the people who organised the first successful protest for Macedonia on the 21st January. Our joy and emotions are beyond words, because we just know what unites us and we fight for it, overcoming obstacles and people who want to undermine our actions with vague and unfounded accusations,” she added. first_imgIn the face of a declining workforce and aging infrastructure at Offutt Air Force Base, Omaha officials are looking at ways to bolster the standing of the installation even in the absence of a future BRAC round.“It’s important that we protect the base, keep its assets in Nebraska, including the thousands of men and women that are there serving our country,” Ken Stinson, head of the Nebraska Military Support Coalition, told the Omaha World-Herald.One positive for Offutt is DOD’s decision to replace U.S. Strategic Command’s command and control center with a new $1.2 billion headquarters, a move that likely secures a long-term future for the installation.But Stinson remains concerned that Offutt’s other commands could be relocated to another Air Force base relatively easily. The Air Force wouldn’t need a base closure round to consolidate missions or relocate them, according to Stinson.“We are still concerned about the loss of commands at Offutt,” he said. “I think the threat is very real.”Another threat to the base is the poor condition of its runway, which the Air Force has rated as the worst among 17 Air Combat Command airfields. To remedy the situation, elected officials and business leaders in Nebraska are supporting a runway reconstruction project that could cost up to $125 million, according to the story.“We have to be forward-looking, forward-thinking,” said State Sen. But today we learned some more details about just how and when the company is making the leap from the small digital play of video games to the sprawling physical play of amusement parks.Super Nintendo World is coming to Osaka’s Universal Studios Japan in time for the 2020 Tokyo Olympics (teased this past summer by Japanese Prime Minister Shinzo Abe in a Mario hat) before expanding to Orlando and Hollywood.Existing Universal Studios’ attractions feature lovingly detailed recreations of the worlds of our favorite #brands. The crown jewel is the massive and meticulous Wizarding World of Harry Potter with its butterbeer, dragon roller coasters, goblin bankers, and infrared wands. But other sections of the parks are nearly as impressive. I still carry around my “Bort” keychain from The Simpsons Park, also featuring actual sad fast food workers at a fictional Krusty Burger. So Nintendo fans should have faith that Super Nintendo World does right by the characters.What will the actual rides at Super Nintendo World even be? The press release mentions “expansive and multilevel environments filled with unprecedented, state-of-the-art rides, interactive areas, shops, and restaurants.” The concept art shows off an impressive but vague Mario playground. But aside from that, all we can do is speculate. So let’s do that! How else are we going to survive these next four years mortgaging our homes to Tom Nook to afford a ticket??For actual Nintendo theme park ideas, Wii U launch game Nintendo Land is probably a good place to look. Who wouldn’t want to ride an F-Zero roller coaster or a Metroid shooting range? However, we’d like to offer some more… conceptually ambitious ideas.1. BrooklynMario is Nintendo’s biggest star, so of course he’s going to be featured prominently at Super Nintendo World. But instead of going the obvious route with a Mushroom Kingdom Park or Isle Delfino water slide, we suggest Universal pay tribute to Mario’s working-class plumbing roots with a full-scale recreation of 1980s Brooklyn, New York. Captain Lou Albano would be so proud.2. King Dedede’s Pleasure PalaceOf all the Nintendo characters that embody pure hedonism, the parka-wearing penguin King Dedede of the Kirby franchise is my favorite. Depending on how family friendly Super Nintendo World wants to be, a “Pleasure Palace” could be a few different, vague things. But no matter what the attraction has to play the slowed-down, pimped-out version of Dedede’s theme song.3. Fire Emblem Child GeneratorSome theme parks already have this questionable attraction where you and a partner pay to have your faces mashed up to show your hypothetical child. Since pairing off characters and recruiting their future children is already a feature in the recent Fire Emblem games, there’s no reason why Nintendo can’t get it on this designer baby action.4. Isiah Whitlock, Jr.’s Doc Louis’s Punch-Out!! GymIf you’re a buff dad taking your kids on vacation, you care a lot about the quality of a hotel gym. So a Punch-Out!!-themed gym with pink hoodies and giant fake versions of Glass Joe, King Hippo, and Mike Tyson to beat up could be a real hit. But to really put this over the top, Nintendo should get Isiah Whitlock of The Wire to reprise his role as famous chocolate-crazed coach Doc Louis. That’d be the sheeeeeeeeeeeeeeeeit.5. Pokemon Go ParkPokemon Go maybe isn’t quite what it used to be, but it’s still a huge phenomenon. So Nintendo would be stupid not to stuff Super Nintendo World full of rare Pokemon to catch in augmented reality. I just hope they’re fenced off in one designated area of the park so the rest of us can enjoy ourselves without worrying about bumping into would-be trainers in an already crowded space.6. Exit Through Wario’s Gift ShopI’ve already talked about Wario is Nintendo’s brilliant tool for commenting on crass consumerism while still profiting from it. Explore further Although the charger, called HYmini, should be initially charged via an electrical wall outlet (which takes about 4 hours), it can be topped off away from home in windy or sunny conditions. With enough solar batteries, it’s possible to fully charge the HYmini without any electrical power. Wind power is intended solely for supplemental charging, though. When fully charged, HYmini’s 5V/1A lithium ion battery can provide power for cell phones, PDAs, MP3 players, iPods, and even digital cameras. Gadgets are hooked up to the charger via a USB cable and various adapters that are included in the package. miniWIZ claims the charger´s battery can be recharged up to 500 times, providing at least 1000mA/h of storage capacity that can be transferred to mobile devices. HYmini’s built-in wind charger consists of a micro wind power generator activated by a tiny fan. At wind speeds between 9 and 40 mph, the turbine can provide up to 1W of power with a 65 mA capacity. A green LED lights up when charging, which can also be used as a night light. The input current depends on the wind speed: in tests, 20 minutes of 19-mph winds could generate enough charge to power an MP3 player for 40 minutes, a cell phone for 4 minutes, or a digital camera for 20 pictures. The company suggests that the charger would be ideal when biking, skiing, or participating in similar high-speed activities, although it caps off at 40 mph for safety reasons. The charger is moisture-proof, and the turbine is made of soft PVC that breaks on impact to avoid injury.
